Issuing of Amended Forms Pursuant to the Criminal Procedure Rules 2020 and Criminal Practice Directions 2023 – October 2023

Summary of Key Changes

The Lord Chief Justice has authorised the amending of four forms issued pursuant to Rule 5.1 of the Criminal Procedure Rules 2020 and paragraph 1.1.6 of the Criminal Practice Directions 2023. The amended forms come into force on 2nd October 2023.

The amended forms are:

  1. Application to vary or revoke a behaviour order pursuant to Criminal Procedure Rule 31.5.
  2. Application by defendant to vary or discharge a restraining order pursuant to Criminal Procedure Rule 31.5 and section 361 of the Sentencing Act 2020 or section 5A of the Protection from Harassment Act 1997
  3. Application by a protected person to vary or discharge a restraining order pursuant to Criminal Procedure Rule 31.5 and section 361 of the Sentencing Act 2020 or section 5A of the Protection from Harassment Act 1997
  4. Application by person with legal aid to change solicitors, pursuant to the Legal Services Act 2007, Criminal Legal Aid (Determinations by a Court and Choice of Legal Representative) Regulations 2023 and Criminal Procedure Rule 46.4

These forms have been amended to reflect changes introduced by the Criminal Procedure (Amendment No. 2) Rules 2023, which take effect on 2nd October 2023. The forms can be found here and will be available from 2nd October 2023.
